By accessing or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with these Terms, you must not access or use our Services.

2. Acceptance of Terms

By creating an account, accessing, browsing, or using any of our Services, you expressly acknowledge and agree to:

  • "Account Credit" means monetary value stored in your account that can be used across all Nobregas services.
  • "Subscription" means any recurring payment arrangement for continued access to Services.
  • "Nobregas Brand" includes all services, products, and applications operated under Nobregas Org, including BusLink and other affiliated offerings.

4. Eligibility

To use our Services, you must:

  • Be at least 13 years of age (or the minimum age required in your jurisdiction);
  • If you are under 18 years of age, have obtained parental or guardian consent;
  • Have the legal capacity to enter into a binding contract;
  • Not be prohibited from using the Services under applicable laws;

  • Not have been previously suspended or banned from using our Services.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, particularly if we believe there is a violation of these Terms.

5. Account Registration and Security

  • Maintain and promptly update your account information;

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Use a strong, unique password for your account;
  • Not share your account credentials with any third party;
  • Immediately submit a support ticket through our Privacy & Data Department if you suspect unauthorized access;
  • Log out of your account at the end of each session when using shared devices.

5.3 Account Suspension

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms or engaged in fraudulent, abusive, or illegal activity.

6. Services Provided

6.1 Service Availability

Nobregas Org provides a variety of digital services and applications, including but not limited to:

  • BusLink - Transportation and routing services;
  • LinkCV - Professional portfolio and CV hosting;
  • WHMCS themes and customization services;
  • Productivity tools and applications;
  • File compression and optimization tools;
  • Gaming resources and server hosting;
  • Other current and future digital products and services.

6.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

6.3 Service Levels

While we strive to provide reliable and uninterrupted service, we do not guarantee that our Services will be available at all times or free from errors, delays, or interruptions. Scheduled maintenance and updates may temporarily affect service availability.

7. User Obligations and Acceptable Use

As a user of our Services, you agree to:

  • Use the Services only for lawful purposes and in accordance with these Terms;
  • Respect the intellectual property rights of Nobregas and third parties;
  • Not impersonate any person or entity or misrepresent your affiliation;
  • Provide accurate information when requested;

  • Not interfere with or disrupt the Services or servers/networks connected to the Services;
  • Not attempt to gain unauthorized access to any portion of the Services;

  • Use reasonable bandwidth and resources when accessing our Services.

8. Prohibited Conduct

You expressly agree NOT to:

  • Use our Services for any illegal purpose or in violation of any laws;
  • Engage in fraudulent activities or money laundering;
  • Distribute malware, viruses, or other harmful code;
  • Engage in phishing, scamming, or deceptive practices;
  • Violate any intellectual property rights.

8.2 Abusive Behavior

  • Harass, threaten, or intimidate other users or our staff;
  • Post or transmit hate speech, discriminatory content, or violent material;
  • Engage in spamming or unsolicited advertising;
  • Manipulate or exploit system vulnerabilities;
  • Create multiple accounts to circumvent restrictions.

8.3 Technical Abuse

  • Reverse engineer, decompile, or disassemble any part of our Services;
  • Use automated scripts, bots, or crawlers without authorization;
  • Attempt to bypass security measures or access controls;
  • Overload or disrupt our infrastructure through denial-of-service attacks;
  • Extract, scrape, or harvest data from our Services without permission.

Violation of these prohibitions may result in immediate termination of your account and legal action.

9. Payment and Billing

9.1 Pricing

Prices for our Services are displayed on our website and are subject to change at any time. All prices are in the currency specified at the time of purchase. We reserve the right to modify pricing with notice to existing subscribers.

9.2 Payment Methods

We accept various payment methods as indicated during checkout. By providing payment information, you represent and warrant that:

  • You are authorized to use the payment method;
  • The information you provide is accurate and current;
  • You will maintain sufficient funds or credit to complete payments;
  • You authorize us to charge the applicable fees to your payment method.

9.3 Billing and Subscriptions

For subscription-based Services:

  • Subscriptions automatically renew unless cancelled before the renewal date;
  • You will be charged at the beginning of each billing cycle;
  • Subscription fees are non-refundable except as stated in our Refund Policy;
  • You may cancel your subscription at any time through your account settings;
  • Cancellation takes effect at the end of the current billing period.

9.4 Failed Payments

If a payment fails, we may:

  • Suspend access to paid Services;
  • Retry the payment method on file;
  • Contact you to update payment information;
  • Terminate your account after repeated failures.

9.5 Taxes

You are responsible for all applicable taxes, duties, and governmental charges. We will collect such taxes if required by law.

10. Refund Policy

Important: Please read our refund policy carefully before making a purchase.

10.1 24-Hour Monetary Refund Window

We offer a 24-hour refund window for monetary refunds. To be eligible for a full monetary refund to your original payment method, you must:

  • Submit a refund request within 24 hours of your purchase;
  • Submit a support ticket through our Billing Department with your order details;
  • Provide a valid reason for the refund request;
  • Not have violated these Terms of Service;
  • Not have excessively used or consumed the Service.

Monetary refunds requested within the 24-hour window will be processed within 5-10 business days to your original payment method.

10.2 Refunds as Account Credit (After 24 Hours)

After the initial 24-hour window, refunds will be issued exclusively as Account Credit. Account Credit:

  • Will be added to your Nobregas account balance;
  • Can be used for any Service within the Nobregas brand ecosystem;
  • Never expires and remains available for future purchases;
  • Is non-transferable and cannot be exchanged for cash;
  • Can be applied to BusLink, LinkCV, WHMCS themes, and all other Nobregas services;
  • Will be credited within 3-5 business days of refund approval.

10.3 Non-Refundable Items

The following are non-refundable under any circumstances:

  • Services that have been fully consumed or delivered;
  • Digital products that have been downloaded or accessed;
  • Custom development or consultation services already performed;
  • Subscription fees for periods already elapsed;
  • Purchases made with Account Credit (credit-to-credit refunds not permitted);
  • Third-party service fees or transaction costs.

10.4 Refund Request Process

To request a refund:

  1. Submit a support ticket through our Billing Department;
  2. Select "Billing Department" when creating your ticket;
  3. Include your order number, account email, and purchase date;
  4. Provide a detailed explanation for your refund request;
  5. Allow up to 3 business days for our team to review your request;
  6. Receive confirmation and timeline for refund processing.

10.5 Discretionary Refunds

We reserve the right to offer refunds outside of this policy on a case-by-case basis at our sole discretion. Such refunds do not create a precedent or obligation for future refunds.

11. Intellectual Property Rights

11.1 Ownership

All content, features, functionality, and intellectual property associated with our Services, including but not limited to software, text, graphics, logos, images, audio, video, data compilations, and the compilation thereof (collectively, "Nobregas Content") are owned by Nobregas Org, our licensors, or other content providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11.2 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal or internal business purposes. This license does not include:

  • Any right to resell or commercial use of the Services;
  • Collection or use of product listings, descriptions, or prices;
  • Derivative use of the Services or their content;
  • Downloading or copying of account information;
  • Use of data mining, robots, or similar data gathering tools.

11.3 User Content

You retain ownership of any content you submit, post, or transmit through our Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with providing and promoting the Services.

11.4 Trademarks

The Nobregas name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Nobregas Org or its affiliates. You may not use such marks without our prior written permission.

11.5 DMCA Compliance

We respect intellectual property rights. If you believe content on our Services infringes your copyright, please contact us at legal@nobregas.org with detailed information about the alleged infringement.

12. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Termination

15.1 Termination by You

You may terminate your account at any time by:

  • Accessing your account settings and selecting account deletion;
  • Submitting a support ticket through our Privacy & Data Department to request account deletion;
  • Ceasing all use of our Services.

Account termination does not relieve you of any obligations to pay outstanding fees or charges.

15.2 Termination by Us

We reserve the right to suspend or terminate your account and access to Services, with or without notice, for any reason, including:

  • Violation of these Terms;
  • Fraudulent or illegal activity;
  • Extended period of inactivity;
  • Request by law enforcement or government agencies;
  • Discontinuation of Services;
  • Any conduct we deem harmful to other users, us, or third parties.

15.3 Effect of Termination

Upon termination:

  • Your right to access and use the Services immediately ceases;
  • We may delete your account data and User Content;
  • Account Credit balances may be forfeited (subject to applicable law);
  • Outstanding payment obligations remain enforceable;
  • Sections of these Terms that by their nature should survive will continue to apply.

16. Warranties and Disclaimers

16.1 No Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • NON-INFRINGEMENT;
  • TITLE;
  • ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT;
  • UNINTERRUPTED OR ERROR-FREE OPERATION.

16.2 Use at Your Own Risk

You acknowledge and agree that:

  • You use our Services at your own risk;
  • We do not warrant that Services will meet your requirements;
  • We do not warrant that Services will be secure, timely, or error-free;
  • Results obtained from Services may not be accurate or reliable;
  • Defects in Services may not be corrected.

16.3 Jurisdiction-Specific Rights

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, some of the above exclusions may not apply to you.

17. Limitation of Liability

17.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOBREGAS ORG, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, OR USE;
  • LOSS OF BUSINESS OPPORTUNITY;
  • PERSONAL INJURY OR PROPERTY DAMAGE;
  • DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICES;
  • DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA;
  • DAMAGES ARISING FROM THIRD-PARTY CONDUCT OR CONTENT.

17.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

17.3 Basis of the Bargain

You acknowledge that we have set our prices and entered into these Terms in reliance upon the limitations of liability set forth herein, which allocate risk between us and form the basis of our bargain.

17.4 Applicable Law

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless Nobregas Org, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms;
  • Your use or misuse of the Services;
  • Your violation of any third-party rights, including intellectual property rights;
  • Your violation of any applicable laws or regulations;
  • Your User Content or any content you submit, post, or transmit;
  • Any fraudulent or illegal activity;
  • Any claim that your User Content caused damage to a third party.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

19. Modifications to Terms

19.1 Right to Modify

We reserve the right to modify, amend, or update these Terms at any time. When we make changes, we will:

  • Notify you via email or through the Services (for material changes);

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the jurisdiction in which Nobregas Org is registered, without regard to its conflict of law provisions.

20.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in our registered jurisdiction for the resolution of any disputes arising from these Terms or your use of the Services.

20.3 International Users

If you access our Services from outside our jurisdiction, you are responsible for compliance with local laws. We make no representation that Services are appropriate or available for use in all locations.

21. Dispute Resolution

21.1 Informal Resolution

Before initiating formal legal proceedings, you agree to first contact us at legal@nobregas.org to seek an informal resolution. We will attempt to resolve disputes in good faith through negotiation.

21.2 Mandatory Arbitration

If informal resolution fails, any dispute arising from these Terms or the Services shall be resolved through binding arbitration, except where prohibited by law. The arbitration shall be conducted by a mutually agreed-upon arbitrator in accordance with applicable arbitration rules.

21.3 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

21.4 Exceptions

Notwithstanding the above, either party may seek equitable relief in court to protect intellectual property rights or confidential information.

22. Miscellaneous Provisions

22.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms specific to certain Services, constitute the entire agreement between you and Nobregas Org regarding the Services and supersede all prior agreements and understandings.

22.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

22.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Nobregas Org.

22.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

22.5 No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Nobregas Org.

22.6 Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

22.7 Notices

Notices to you may be made via email, regular mail, or postings on the Services. Notices to us should be sent to legal@nobregas.org.

22.8 Language

These Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version shall prevail.

22.9 Survival

Provisions that by their nature should survive termination of these Terms shall survive, including but not limited to intellectual property rights, disclaimers, indemnification, and limitations of liability.

Section headings are for convenience only and do not affect the interpretation of these Terms.
