2. Account Registration

To use our hosting services, you must create an account. You agree to:

Service availability is subject to maintenance windows and unforeseen technical issues. While we strive for high availability, WE DO NOT GUARANTEE ANY SPECIFIC UPTIME PERCENTAGE AND CANNOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR CONTINUOUSLY AVAILABLE SERVICE. All services are provided on a best-effort basis.

4. Acceptable Use Policy

You may not use our services for:

• Illegal activities or content
• Spam, phishing, or unsolicited bulk email
• Malware, viruses, or malicious software
• Copyright infringement or piracy
• Adult content or pornography
• Excessive resource consumption affecting other users
• Cryptocurrency mining
• Proxy or VPN services (unless authorized)
• Tor exit nodes

Violation of this policy may result in immediate service suspension or termination without refund.

• Security threats or malicious activity

You may cancel your service at any time through your client portal. Cancellation takes effect at the end of the current billing period.

9. Support

We provide technical support via ticket system. Support is available for:

• Server and hosting platform issues
• Control panel assistance
• Email configuration
• DNS and domain management

Support does not include custom coding, software debugging, or third-party application troubleshooting.

• Power outages, electrical failures, or utility disruptions
• Internet backbone failures, network outages, or routing anomalies

• Failure or disruption of third-party services, cloud providers, or datacenter operators
• Supply chain disruptions, hardware shortages, or equipment failures

• Any other event beyond the reasonable control of Nobregas Hosting

During a Force Majeure Event, Nobregas Hosting's obligations are suspended for the duration of the event. Nobregas Hosting will not be required to provide refunds, credits, or compensation for service disruptions caused by Force Majeure Events.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. 1. Service Description

The Nobregas Web Hosting Service provides managed web hosting through a web-based control panel (cPanel or equivalent). The Service includes website file hosting, email hosting, database hosting, DNS management, SSL certificates, and other features as specified in your plan, subject to the resource limits and fair use policies described herein.

2. Account Provisioning and Access

Your web hosting account is provisioned through our billing system (WHMCS) upon purchase of a web hosting plan. Account credentials are generated during provisioning. You are responsible for maintaining the confidentiality of your control panel login credentials, FTP/SFTP credentials, email credentials, and any other access credentials associated with your account.

You are solely responsible for all activity that occurs under your account, whether authorized or unauthorized. You must immediately notify Nobregas Hosting of any unauthorized use of your account or any other breach of security. Nobregas Hosting will not be liable for any loss or damage arising from your failure to safeguard your credentials.

3. Resource Limits and Fair Use

Each web hosting plan specifies resource allocations including, but not limited to:

• Disk storage (NVMe SSD)
• Bandwidth allocation
• CPU cores and processing power
• Physical memory (RAM)
• Entry processes (concurrent connections)
• I/O throughput
• Inode (file) count
• Email accounts and storage
• Databases and database storage
• Addon domains and subdomains

These limits are enforced at the server level using AlmaLinux and other resource management tools. Exceeding your plan limits may result in service throttling, temporary restrictions, or a requirement to upgrade your plan.

All resources, including features described as "unlimited" or "unmetered," are subject to our Fair Use Policy. No hosting plan permits usage that places undue strain on server infrastructure, degrades performance for other customers on the same server, or circumvents resource management tools. We reserve the right to throttle, suspend, or terminate accounts that consume disproportionate resources.

4. Content Responsibility and Compliance

You represent and warrant that Your Content does not and will not: violate any applicable local, national, or international law or regulation; infringe upon any intellectual property right, trademark, copyright, patent, trade secret, or other proprietary right of any third party; contain defamatory, libelous, abusive, threatening, harassing, or fraudulent material; contain malware, viruses, trojan horses, worms, spyware, adware, ransomware, or any other malicious code; facilitate identity theft, phishing, pharming, or any form of fraud; constitute spam, unsolicited bulk communications, or commercial solicitation; or cause harm to minors in any way.

You agree to comply with all applicable laws regarding data protection, privacy, electronic communications, and consumer protection, including but not limited to GDPR, CCPA, CAN-SPAM, COPPA, and any other applicable privacy or data protection legislation. Failure to comply may result in immediate service termination without refund.

5. Acceptable Use — Web Hosting Restrictions

In addition to the Acceptable Use Policy in our General Terms of Service, you agree not to use the Web Hosting Service for:

• Hosting websites or applications that distribute malware, phishing pages, or exploit kits
• Operating open proxies, VPN endpoints, Tor exit nodes, or anonymizing services without prior written authorization
• Running background daemons, cron jobs, or persistent processes that consume excessive resources
• Cryptocurrency mining, blockchain validation, or similar computationally intensive operations
• Hosting adult content, pornographic material, or obscene content
• Hosting pirated software, copyrighted material without authorization, or "warez" sites
• Operating illegal gambling, unlicensed pharmaceutical, or counterfeit goods websites
• Sending unsolicited bulk email (spam) or hosting email lists that do not comply with CAN-SPAM or equivalent laws
• Running IRC servers, bouncers, or bots without prior written authorization
• Hosting file-sharing, torrent trackers, or download sites for copyrighted material
• Attempting to access other customers' accounts, files, databases, or server resources
• Performing security scanning, penetration testing, or vulnerability assessment against our infrastructure without prior written authorization
• Using automated scripts that place excessive load on shared server resources
• Hosting content that promotes violence, terrorism, or hate against any group

Violation of these restrictions may result in immediate service suspension or termination without prior notice and without refund. Nobregas Hosting reserves sole discretion in determining what constitutes a violation.

6. Backups and Data Loss

While Nobregas Hosting provides automated daily backups as a courtesy service, YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING YOUR OWN INDEPENDENT BACKUPS OF ALL DATA, FILES, DATABASES, EMAIL, CONFIGURATIONS, AND ANY OTHER CONTENT ASSOCIATED WITH YOUR ACCOUNT.

7. Uptime and Availability

While Nobregas Hosting strives for high availability, WE DO NOT GUARANTEE ANY SPECIFIC UPTIME PERCENTAGE, INCLUDING 99.9% UPTIME, UNLESS EXPLICITLY STATED IN A SEPARATE, SIGNED SERVICE LEVEL AGREEMENT (SLA). The web hosting service is provided on a best-effort basis.

Service interruptions may occur due to scheduled maintenance, emergency maintenance, hardware failure, software updates, security incidents, network issues, datacenter events, force majeure events, or any other circumstances beyond our reasonable control. We will endeavor to provide advance notice of scheduled maintenance when possible.

8. Security Responsibilities

9. Domain, DNS, and Email Services

Domain registration and management may be offered through third-party registrars. Nobregas Hosting is not a domain registrar and is not responsible for domain registration disputes, transfers, expirations, or WHOIS compliance.

DNS management is provided as part of the hosting service. You are responsible for configuring your DNS records correctly. Misconfigured DNS records may result in service disruption, and Nobregas Hosting is not liable for any consequences of DNS misconfiguration.

Email hosting is provided as a component of the web hosting service. You are solely responsible for the content of emails sent from your account. Abuse of email services (including spam, phishing, or spoofing) will result in immediate suspension. Nobregas Hosting is not liable for undelivered, delayed, or lost emails.

10. SSL Certificates

Free SSL certificates (Let's Encrypt or equivalent) are provided as a courtesy. SSL certificates are issued, renewed, and managed automatically where possible. Nobregas Hosting does not guarantee uninterrupted SSL certificate availability and is not liable for certificate issuance failures, renewal failures, or certificate revocation by the certificate authority.

If you require extended validation (EV), organization validation (OV), or wildcard certificates beyond what is provided free, you are responsible for obtaining and installing them.

11. Third-Party Software and Applications

You may install third-party CMS platforms (such as WordPress, Joomla, Drupal), plugins, themes, scripts, and applications on your hosting account. NOBREGAS HOSTING DOES NOT DEVELOP, MAINTAIN, AUDIT, OR ENDORSE ANY THIRD-PARTY SOFTWARE AND IS NOT RESPONSIBLE FOR ITS FUNCTIONALITY, SECURITY, COMPATIBILITY, OR PERFORMANCE.

You are solely responsible for: keeping all third-party software updated to the latest stable versions; reviewing and understanding the license terms of any software you install; ensuring third-party software does not violate applicable laws, our Terms of Service, or the rights of any third party; and addressing any vulnerabilities or security issues introduced by third-party software.

• Failure or disruption of third-party services, cloud providers, or datacenter operators
• Supply chain disruptions, hardware shortages, or equipment failures
• Labor disputes, strikes, or work stoppages
• Any other event beyond the reasonable control of Nobregas Hosting

16. Suspension and Termination

We may suspend or terminate your Web Hosting Service immediately, without prior notice and without refund, for:

• Violation of these Terms or the Acceptable Use Policy
• Non-payment of invoices (automatic suspension after 7 days overdue)
• Hosting content that is illegal, infringing, or harmful
• Excessive resource consumption affecting other users
• Security threats or malicious activity originating from your account
• Legal requirements, court orders, or law enforcement requests
• DMCA takedown notices or copyright infringement claims
• Spam complaints or email abuse
• Any activity that, in our sole discretion, poses a risk to our infrastructure, reputation, or other customers

You may cancel your service at any time through the WHMCS client portal. Cancellation takes effect at the end of your current billing period. Unused service time is not refundable.

17. Modifications to These Terms

We may update this Web Hosting Terms of Service Addendum at any time. Material changes will be communicated via email or prominently displayed on our website. Your continued use of the Web Hosting Service after changes constitutes acceptance. If you do not agree to the updated terms, you must discontinue use of the Service and cancel your plan.

18. Governing Law and Dispute Resolution

This addendum is governed by the same laws and dispute resolution mechanisms as set forth in the Nobregas Hosting General Terms of Service. Any legal proceedings relating to your use of the Web Hosting Service shall be brought exclusively in the courts designated in the General Terms of Service.

19. Severability and Entire Agreement

If any provision of this addendum is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. The invalidity of any provision shall not affect the validity or enforceability of any other provision.

This addendum, together with the Nobregas Hosting General Terms of Service, Privacy Policy, and any applicable product-specific addenda, constitutes the entire agreement between you and Nobregas Hosting with respect to the Web Hosting Service and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

1. Service Description

The Nobregas MySQL Hosting service provides managed MySQL database hosting through a web-based control panel. The Service allows you to create and manage MySQL databases, database users, privileges, backups, and execute SQL queries, subject to the resource limits of your plan.

2. Account Provisioning and Access

2.1 Account Creation

Your MySQL Hosting account is provisioned through our billing system (WHMCS) upon purchase of a MySQL Hosting plan. Account credentials are generated during provisioning. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

2.2 Authentication

You must authenticate using your email and password to access the MySQL Panel. You may optionally enable "remember me" functionality, which stores a secure token on your device for up to 30 days. You are responsible for logging out of shared or public devices.

2.3 phpMyAdmin Access

If your plan includes phpMyAdmin access, you may access phpMyAdmin via Single Sign-On (SSO) from within the MySQL Panel. phpMyAdmin SSO tokens are valid for 30 seconds and are encrypted and signed. You must not share, capture, or replay SSO tokens. phpMyAdmin is provided as-is for direct database management, and any actions you perform through phpMyAdmin are subject to these Terms.

3. Resource Limits and Fair Use

3.1 Plan Limits

Each MySQL Hosting plan specifies resource limits including, but not limited to:

• Maximum number of databases
• Maximum storage (in megabytes)
• Maximum concurrent database connections
• Maximum queries per hour
• Feature availability (remote access, phpMyAdmin access, daily backups)

These limits are enforced by the system. If you reach a limit, you will be unable to perform the associated action (e.g., creating a new database when at your database quota) until you upgrade your plan or reduce usage.

3.2 Storage

Storage is calculated based on the sum of all your database sizes as reported by MySQL metadata (information_schema). Storage limits are advisory on most operations but may be enforced at the system level. You must not attempt to circumvent storage limits by any means.

3.3 Fair Use

All resources, including "unlimited" or unmetered features if any, are subject to fair use. We reserve the right to throttle, suspend, or terminate accounts that consume disproportionate resources to the detriment of other users on the same MySQL node.

3.4 Node Assignment

Your databases are hosted on MySQL server nodes managed by Nobregas Hosting. We assign your account to a node during provisioning. We reserve the right to migrate your databases to a different node at any time for load balancing, maintenance, or capacity reasons, with or without prior notice.

4. Database Operations and Restrictions

4.1 Database Naming

Database names must consist only of alphanumeric characters and underscores, must not exceed 64 characters in total length (including your account prefix), and must be unique within the MySQL node. Your databases are automatically prefixed with your account-specific prefix.

4.2 Table Creation

You may create tables using the visual table builder in the MySQL Panel. All column types, constraints, and properties must be selected from the supported options provided by the panel. You must not attempt to inject arbitrary SQL through table or column names.

4.3 Permitted SQL Operations

Through the SQL Query interface, you may execute:

• Read operations: SELECT, SHOW, DESCRIBE, EXPLAIN
• Data modification: INSERT, UPDATE, DELETE
• Structure modification: CREATE TABLE, ALTER TABLE, DROP TABLE, TRUNCATE TABLE
• Other standard SQL statements not on the blocked list

4.4 Blocked SQL Operations

The following SQL commands are blocked and cannot be executed through the query interface:

• GRANT, REVOKE — Use the panel's privilege management interface instead
• CREATE USER, DROP USER, ALTER USER — Use the panel's user management interface instead
• SET PASSWORD — Use the panel's user management interface instead
• FLUSH, RESET — Server maintenance commands reserved for administrators
• SHUTDOWN — Server control commands reserved for administrators

4.5 Query Limits

• Maximum query length: 65,535 characters per query submission
• Maximum result set: 1,000 rows returned per SELECT query
• Multiple statements may be executed in a single submission; execution stops at the first error
• Query history stores the last 50 queries per database

4.6 Destructive Operations

The following operations are irreversible and result in permanent data loss:

• Dropping a database (removes all tables, data, and associated backups)
• Dropping a table (removes the table and all its data)
• Truncating a table (removes all rows and resets auto-increment)
• Deleting a row

5. Database Users and Privileges

5.1 MySQL User Creation

You may create MySQL database users through the panel. MySQL usernames are subject to the same naming restrictions as database names. Each MySQL user exists on the MySQL node and may be granted access to one or more of your databases.

5.2 Privilege Management

You may assign privileges to your MySQL users using the panel's privilege management interface. Available privileges include standard MySQL privileges (SELECT, INSERT, UPDATE, DELETE, CREATE, DROP, ALTER, INDEX, CREATE TEMPORARY TABLES, LOCK TABLES, EXECUTE, CREATE VIEW, SHOW VIEW, CREATE ROUTINE, ALTER ROUTINE, EVENT, TRIGGER, REFERENCES). You must not attempt to grant global or administrative privileges.

5.3 User Responsibility

You are solely responsible for:

• The security of MySQL user credentials you create
• The privilege levels you assign to MySQL users
• Any database activity performed by MySQL users you create
• Ensuring MySQL user credentials are not shared with unauthorized parties

5.4 Remote Access

If your plan includes remote access, you may whitelist up to 20 IP addresses (IPv4 or IPv6) for external MySQL connections. You are responsible for ensuring that whitelisted IP addresses are secure and that remote connections use encrypted channels. Nobregas Hosting is not liable for unauthorized access resulting from your remote access configuration.

6. Backups

6.1 Manual Backups

You may create manual backups of your databases through the MySQL Panel. Manual backups generate a complete SQL dump of your database structure and data. You may download, restore, or delete manual backups at any time.

6.2 Automated Daily Backups

If your plan includes automated daily backups, we will create daily backups of your databases automatically. Automated backups are retained according to the backup retention period specified in your plan (default 30 days). Automated backups are provided as a courtesy.

6.3 Backup Disclaimer

6.4 Backup Restoration

Restoring a backup will overwrite existing tables and data in the target database. You acknowledge that restoration is a destructive operation with respect to the current database contents. We recommend creating a fresh backup before restoring from a previous one.

6.5 Backup Storage

Backup files are stored on our servers. Backup storage does not count toward your database storage quota unless otherwise specified. We reserve the right to delete backup files upon service termination or in accordance with our retention policies.

7. Import and Export

7.1 Import

You may import SQL files (plain or gzip-compressed) into your databases via the MySQL Panel. Imported files must not exceed 50 MB in size. You are solely responsible for the contents of imported files. Importing malicious, corrupted, or excessively large SQL may result in database corruption, performance degradation, or service disruption, for which Nobregas Hosting is not liable.

7.2 Export

You may export your databases in SQL format or export individual tables in CSV format at any time. We recommend exporting your data regularly as an additional backup measure.

7.3 Content Responsibility

You are solely responsible for all data you import into the Service. Imported data must comply with all applicable laws and the Nobregas Hosting Acceptable Use Policy. Importing data containing malware, illegal content, or data that infringes third-party rights is strictly prohibited and may result in immediate service termination.

8. Acceptable Use — MySQL-Specific Restrictions

In addition to the Acceptable Use Policy in our general Terms of Service, you agree not to use the MySQL Hosting service for:

• Hosting databases containing illegal content, stolen data, or data obtained without proper authorization or consent
• Running databases that serve as backend infrastructure for spam, phishing, malware distribution, or any illegal activity
• Attempting to access, modify, or interfere with databases, MySQL users, or data belonging to other customers
• Attempting to escalate MySQL privileges beyond those granted through the panel interface
• Attempting to execute blocked SQL commands through any means, including encoded queries, stored procedures, or events designed to bypass restrictions
• Using the query interface to perform denial-of-service attacks, resource exhaustion, or purposeful degradation of MySQL node performance
• Storing sensitive personal data (such as government-issued identification numbers, financial account numbers, health records, or payment card data) without appropriate security measures and legal basis, and in compliance with all applicable data protection laws
• Using the import functionality to inject malicious SQL that could compromise server security
• Sharing MySQL user credentials or phpMyAdmin SSO tokens with unauthorized third parties
• Attempting to reverse-engineer, decompile, or replicate the MySQL Panel software
• Creating excessive databases, users, or backups to circumvent plan limits or consume disproportionate resources
• Using automated scripts or bots to interact with the MySQL Panel interface without prior written authorization

9. Data Ownership and Intellectual Property

9.1 Your Data

You retain all ownership rights to the data you store in your MySQL databases. By using the Service, you grant Nobregas Hosting a limited license to store, process, backup, replicate, and transmit your data solely as necessary to provide the Service.

9.2 Our Software

The MySQL Panel software, including its source code, user interface, design, architecture, and all associated documentation, is the exclusive intellectual property of Nobregas Hosting. You are granted a non-exclusive, non-transferable, revocable license to use the MySQL Panel solely for the purpose of managing your MySQL databases during your active service period. You must not copy, modify, distribute, reverse-engineer, decompile, disassemble, or create derivative works from the MySQL Panel software.

9.3 Feedback

Any suggestions, ideas, or feedback you provide regarding the MySQL Panel may be used by Nobregas Hosting without obligation or compensation to you.

10. Service Suspension and Termination

10.1 Suspension by Nobregas Hosting

We may suspend your MySQL Hosting service immediately and without prior notice for:

• Violation of these Terms or the Acceptable Use Policy
• Non-payment of invoices (automatic suspension after 7 days overdue)
• Excessive resource consumption affecting other users on the same MySQL node
• Security threats, unauthorized access attempts, or malicious activity originating from your account
• Legal requirements or law enforcement requests

10.2 Termination by Nobregas Hosting

We may terminate your MySQL Hosting service for:

• Repeated or severe violations of these Terms
• Extended non-payment beyond our grace period
• Fraud or misrepresentation
• Legal requirements

Upon termination:

• All your databases will be permanently dropped from the MySQL node
• All MySQL users will be permanently deleted
• All backup files will be permanently deleted from disk
• All associated panel records (query history, activity logs, IP whitelists) will be permanently deleted
• This action is irreversible — data cannot be recovered after termination

10.3 Termination by You

You may cancel your MySQL Hosting service at any time through your WHMCS client portal. Cancellation takes effect at the end of your current billing period. We recommend exporting or downloading all your data before cancellation, as all data will be permanently deleted upon service termination.

10.4 No Obligation to Retain Data Post-Termination

Once your service is terminated (whether by you or by us), Nobregas Hosting has no obligation to retain, export, or provide access to your databases, backups, query history, or any other data. Any data remaining on our systems after termination will be permanently deleted within 30 days.

11. Service Level and Availability

11.1 Uptime

We strive for high availability of the MySQL Panel and underlying MySQL nodes. However, we do not guarantee 99.9% or any specific uptime percentage for the MySQL Hosting service. The MySQL Hosting service SLA, if any, is as specified in your plan documentation.

11.2 Maintenance

We may perform scheduled and emergency maintenance on MySQL nodes, the MySQL Panel, or supporting infrastructure. Scheduled maintenance will be communicated in advance when possible. Emergency maintenance may occur without notice.

11.3 No Guarantee of Performance

Database performance (query speed, connection latency, throughput) depends on many factors including your schema design, query efficiency, data volume, and shared node load. We do not guarantee specific performance levels.

13. Security Responsibilities

13.1 Shared Responsibility Model

Security is a shared responsibility between you and Nobregas Hosting:

13.2 Vulnerability Reporting

If you discover a security vulnerability in the MySQL Panel or MySQL Hosting infrastructure, you must report it promptly to contact@nobregas.org. You must not exploit, publicize, or share the vulnerability with third parties before it has been addressed. Responsible disclosure will be acknowledged and appreciated.

13.3 Prohibited Security Activities

You must not:

• Attempt to access MySQL nodes, databases, or accounts that do not belong to you
• Perform security testing, penetration testing, or vulnerability scanning against the MySQL Panel or MySQL nodes without prior written authorization
• Attempt to extract, decrypt, or reverse-engineer encrypted credentials stored in the system
• Attempt to exploit the phpMyAdmin SSO mechanism, query parser, or any other component of the MySQL Panel

14. API Access

If your account has an API key, you may use it to interact with the MySQL Panel programmatically. API keys are hashed (SHA-256) and stored securely. You are solely responsible for the security of your API key. If your API key is compromised, you must regenerate it immediately. All API requests are logged and subject to the same Terms of Service as interactive panel usage.

15. WHMCS Integration

Your MySQL Hosting account is linked to your WHMCS billing account. Plan changes, upgrades, downgrades, suspensions, and terminations initiated through WHMCS take effect on your MySQL Hosting service automatically. You acknowledge that billing disputes should be directed to Nobregas Hosting through the WHMCS client portal or support system.

16. Modifications to These Terms

We may update this MySQL Hosting Terms of Service Addendum at any time. Material changes will be communicated via email or prominently displayed in the MySQL Panel. Continued use of the MySQL Service after changes constitutes acceptance. If you do not agree to the updated terms, you must discontinue use of the Service and cancel your plan.

17. Governing Law and Dispute Resolution

This addendum is governed by the same laws and dispute resolution mechanisms as set forth in the Nobregas Hosting general Terms of Service.

18. Severability

If any provision of this addendum is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

This addendum, together with the Nobregas Hosting general Terms of Service, Privacy Policy, and MySQL Hosting Privacy Policy Addendum, constitutes the entire agreement between you and Nobregas Hosting with respect to the MySQL Hosting service.
